OFCCP Compliance Evaluations and Audit Assistance

Mock Audits

Workplace Dynamics will conduct a mock audit that simulates an actual OFCCP audit, including the methodology and procedures.  We will review all the data and materials requested in the desk audit and conduct an evaluation similar to that conducted by OFCCP.  The results of the desk audit analysis will reveal areas of adverse impact and under-representation.  Our work will take place off and onsite to include the following:

  • Offsite
    • Review the technical aspects of your Affirmative Action Plans
    • Conduct the impact ratio and standard deviation analysis on personnel activity
    • Examine employment policies, procedures and practices supporting employment decisions, such as hiring, promotions, and terminations
    • Evaluate employee development programs that support the Affirmative Action program
  • Onsite
    • Review I-9 forms
    • Perform facility inspections
    • Conduct interviews
    • Examine personnel files for documentation to support employment decisions
    • Facilitate management training

We will provide you with a detailed summary report of our findings and will work with you to develop and implement a corrective action plan to reduce or eliminate problem areas.

OFCCP Audit Support

You have just received a letter from OFCCP scheduling a compliance audit.  Don’t panic, but do call us immediately. We will advise you how to proceed and assist you in preparing your response to the government.  Click here for a copy of the OFCCP scheduling letter.

Workplace Dynamics will gladly take on one of several roles during the audit process.  We can advise you behind the scenes or prepare the entire response to OFCCP, as well as act as your liaison to the government.  If you already have a current AAP, we will review it for compliance with the three affirmative action regulations and recommend any necessary modifications.  If you have do not have a current AAP, we will prepare the required plans, along with the supporting documents required for the OFCCP submission.  We will put the entire package together so all you have to do is sign the cover letter and mail the package to OFCCP. 

We will also provide you with a detailed report of your potential problem areas so that you can begin conducting your own internal audit to defend any areas that may later be raised by the government.

December 2012 - Clougherty Packing Co. Settles Lawsuit for $440,000

OFCCP has reached an agreement with Clougherty Packing Co. (subsidiary of Hormel Food Co.) to settle allegations of systemic hiring discrimination against female - mostly Latinas - applicants for laborer positions at their Los Angeles facility between 2007 and 2009. Clougherty will pay $439,538 in back wages, including interest to 1,988 qualified female applicants and will make 700 job ffers as positions become available.
