The following summarizes the key points, as presented in OFCCP’s webinar of March 24, 2015, of E.O. 13672. 

General:

  • E.O. implementation date is April 8, 2015.
  •  Impacts federal contractors with contracts in excess of $10,000 entered into or modified after April 8, 2015.
  • The phrase “LGBT” cannot be used in lieu of “sexual orientation” or “gender identity.
  • E.O. does not change the religious exemption currently in the regulations.

 Changes to existing HR practices:

·        Add “sexual orientation” and “gender identity” to the list of protected categories in the following language:

  • EOE clause in contracts
  • EEO tagline – if you identify all the bases in a detailed tagline, than you must include sexual orientation and gender identity.  OFCCP will be issuing a FAQ shortly.
  • EEO is the Law poster – Until a new EEO is the Law poster is finalized, OFCCP is preparing a supplement, which will be posted on their website.
