Non-Binary Gender Option Added to EEOC Intake Forms


EEOC delivers on commitment made on Transgender Day of Visibility

When an individual believes that they have been subjected to discrimination or harassment in the workplace, they have the right to file a Charge of Discrimination with the Equal Employment Opportunity Commission (EEOC).  To do this, they must complete intake forms for the agency to determine the viability of the charge.   To deliver on a commitment the EEOC made on Transgender Day of Visibility, they have updated their intake forms to add the option for “X” gender marker. 

Specifically, EEOC made the following changes:

  • Updated the voluntary demographic questions relating to gender in the online line public portals, as well as the Online Spanish Initial Consultation Form and Pre-Charge Inquiry Form that are used in lieu of the portal.
  • Changed the charge of discrimination form to include “Mx.” In the list of prefix options.
