Trump picks Janet Dhillon to serve as EEOC Chair and Commissioner


Victoria Lipnic will become a commissioner if Dhillon is confirmed

Janet L. Dhillon has extensive experience working as a general counsel for U.S. Airways, JC Penney and Burlington Coat Factory.  There is speculation that she was selected because Trump wanted a more “business-friendly” voice on the Commission.

The following is a historical perspective of her background.

1984 – Graduated magna cum laude and Phi Beta Kappa from Occidental College with a degree in history and a minor in political science

1991 – Graduated from UCLA Law School – ranked first in her class and was award the Order of the Coif

1991 – 2004 – Associate and then Counsel of Skadden, Arps, Slate, Meagher & Flom LLP

2004 – 2009 – U.S. Airways, Inc.

  • 2004 – Managing Director in the legal department and Associate General Counsel
  • 2005 – Vice President and Deputy General Counsel for U.S. Airways Inc. and the U.S. Airways Group, Inc. which included America West Airlines Inc.
  • 2006 – Chief Compliance Officer, Senior Vice President and General Counsel where she was responsible for corporate compliance, internal audit, Sarbanes-Oxley implementation and environmental issues.
  • 2009 – 2015 – J.C. Penney Company, Inc. – Executive Vice President, General Counsel and Corporate Secretary.  She was responsible for all facets of the legal function, including corporate securities, transactions, litigation, tax, real estate, labor and employment and regulatory issues.  She also oversaw the Company’s Government Affairs functions and the Ethics and Compliance Group.
2015 – Current – Burlington Stores, Inc. - Executive Vice President, General Counsel and Corporate Secretary.   She is responsible for all aspects of the legal function for the retailer that operates over 500 stores nationwide.

While at JCPenney, Ms. Dhillon also served as Chairman of the Board of the Retail Industry Leaders Association Retail Litigation Center for two years.  In 2014, Dhillon was named Outstanding General Counsel – Large Legal Department in the Dallas/Fort Worth area by the Association of Corporate Counsel  and D CEO Magazine.   Previously, Ms. Dhillon also served on the Board of Directors of Dallas CASA and St. Mary’s Food Bank in Phoenix.

Other EEOC News

The five-member commission has one vacancy which has been open since January.  Commission Jenny Yang’s term expires on July 1st; however, according to Bloomberg BNA she may exercise her right to stay on 60 days after her term formally expires.   Yang became a commissioner in May 2013 and was named the chair of EEOC in September 2014 until President Trump named Victoria Lipnic as acting chair on January 25, 2017.
