Governor Cuomo of Signs Two Executive Orders Addressing Compensation for New York State Employers and Contractors

On January 9, 2017, New York Governor Andrew Cuomo signed that following two Executive Orders addressing pay. 

Executive Order 161 “Ensuring Pay Equity By State Employers,” states that “no State entity is permitted to ask, or mandate, in any form, that an applicant for employment provide his or her current compensation, or any prior compensation history, until such time as the applicant is extended a conditional offer of employment with compensation.”

The Order No. 162, “Ensuring Pay Equity By State Contractors,” in addition to providing the current data on gender, race and ethnicity, this Order compels state contractors for all state contracts, agreements, and procurements issued and executed on or after June 1, 2017 to provide detailed workforce utilization reports with job title and salary data to the state agencies and authorities on the following schedule:

• quarterly for all prime contracts over $25,000; and
• monthly for all prime construction contracts over $100,000.Subcontractors working on New York state contracts must also provide the same information for their employees.
