Final Sex Discrimination Guidelines

Yesterday the OFCCP published in the Federal Register the final rule setting forth the requirements that covered contractors must meet under the provisions of E.O. 11246 prohibiting sex discrimination in employment.  The Final Rule updates the antiqued Sex Discrimination Guidelines, originally written in 1970.  The effective date of implementation is August 15, 2016.

The Final Rule provides examples of prohibited sex discrimination in the workplace and also offers examples of best practices.  The rule adds the following:

• Protections related to pregnancy, childbirth and related medical conditions
• Protections to employees who are caregivers and transgender workers
• Prohibitions against sexual harassment and sex stereotypes
• Promotes fair pay practices
• Provides equal access to jobs and developmental opportunities to men and women
